You consent to receive these Terms, any amendments, and any notices in electronic form, and you waive any requirement that such communications be delivered on paper.

The Service is an independent, third-party price-tracking and price-comparison tool for products listed on AliExpress. We are NOT affiliated with, endorsed by, sponsored by, authorized by, or otherwise connected to Alibaba Group Holding Limited, AliExpress, or any of their subsidiaries or affiliates.

Features, functionality, and scope of the Service may change, expand, contract, or disappear at any time without prior notice.

All third-party trademarks, logos, and brand names (including "AliExpress" and "Alibaba") are the property of their respective owners and are used here solely for identification and descriptive purposes.

The Service is offered free of charge and we make no representation, warranty, or service-level commitment concerning availability, response time, throughput, or reliability.

We may pause, throttle, modify, degrade, or discontinue the Service or any feature at any time, for any reason or no reason, without prior notice and without any liability to you.

Because the Service is free, no refund, credit, or compensation of any kind is payable in connection with any interruption, modification, or discontinuation.

The Service is continuously evolving and may include experimental, beta, or pre-release features. Such features are provided "AS IS" and may be unstable, incomplete, or removed at any time.

You acknowledge that the Service is a work in progress and that reliance on any particular feature, data point, or behavior is at your own risk.

The Service integrates with or depends on third-party providers, including but not limited to the AliExpress Open Platform and Affiliate Program, email delivery providers, hosting providers, database providers (Supabase), geo-IP providers, analytics providers (Google Analytics), and payment processors for any future paid features.

We are not responsible or liable for the acts, omissions, outages, data practices, pricing changes, API deprecations, or performance of any third-party provider.

Your use of a third-party service may be subject to that third party's separate terms and privacy policy, which you are responsible for reviewing and accepting.

We may take the Service offline, in whole or in part, at any time and for any duration for scheduled maintenance, unscheduled maintenance, emergency repairs, security incidents, or any operational reason.

We are not obligated to provide advance notice of maintenance windows and are not liable for any impact resulting from maintenance-related downtime.

We reserve the right to restrict access to the Service by country, region, IP address range, device, or jurisdiction for legal, regulatory, sanctions, compliance, or operational reasons.

You are responsible for complying with the local laws of the jurisdiction from which you access the Service. If access from your jurisdiction is unlawful or restricted, you must not use the Service.

THE SERVICE IS PROVIDED "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, ARISING FROM COURSE OF DEALING, USAGE OF TRADE, OR OTHERWISE.

To the fullest extent permitted by applicable law, we disclaim all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, reliability, availability, quiet enjoyment, and uninterrupted operation.

We do not warrant that the Service will be error-free, secure, free of viruses or other harmful components, or that any defects will be corrected.

Prices displayed on the Service are best-effort snapshots fetched from AliExpress's public API and third-party sources. Prices may be delayed, cached, stale by hours or days, localized to a different region's pricing, expressed in the wrong currency, or simply wrong.

You must independently verify the actual current price, availability, shipping cost, taxes, duties, and all other purchase details directly on AliExpress before making any purchase decision.

We are not liable for any price discrepancy, missed deal, wrong deal, failed purchase, financial loss, opportunity cost, or any other financial outcome arising from reliance on price information shown on the Service.

Products shown on the Service may be out of stock, discontinued, region-restricted, or otherwise unavailable at the time of your purchase attempt. We do not independently verify product availability.

Listing a product on the Service does not imply that the product can be purchased, shipped to your location, or delivered within any particular time frame.

Coupons, promo codes, and discount offers displayed on the Service may be expired, region-restricted, user-specific, tier-specific, already consumed, or otherwise invalid at the time of redemption.

Coupon terms, conditions, validity, and eligibility are governed exclusively by AliExpress. We are not a party to any coupon arrangement and are not liable for any failed redemption or denied discount.

Currency conversions shown on the Service are indicative only and are based on third-party exchange-rate data that may be delayed or approximate. We are not a currency authority and do not guarantee any specific exchange rate.

AliExpress, your card network, and your bank will each apply their own conversion rates and fees. Final charges may differ from the figures displayed on the Service.

Price history data is collected on a best-effort basis and may contain gaps, duplicated entries, provider-side errors, timestamp skew, or other inaccuracies.

Historical data is provided for informational and illustrative purposes only and must not be relied upon for financial, purchasing, or other material decisions.

We do not vet AliExpress sellers, verify the authenticity of reviews or ratings, or assess the quality, safety, authenticity, or legality of listed products.

You are solely responsible for researching sellers, verifying product quality, and assessing suitability before making any purchase.

All shipping arrangements, delivery timelines, tracking, customs clearance, import duties, taxes, and other fees are matters between you, AliExpress, the seller, shipping carriers, and the relevant customs or tax authorities.

We are not involved in logistics or customs processes and are not liable for lost, delayed, confiscated, damaged, or misdelivered packages, or for any duties, taxes, or fees imposed on your shipment.

You agree NOT to: (a) use the Service for any unlawful purpose or in violation of any applicable law, regulation, or third-party right; (b) engage in fraud, identity misrepresentation, affiliate-link manipulation, or click fraud; (c) interfere with, disrupt, or overload the Service or its infrastructure; (d) use the Service to violate AliExpress's Terms of Service or any third-party's terms.

We reserve the right to investigate, suspend, block, or take legal action against any user who we reasonably suspect has violated this clause.

You may maintain one account per natural person. Creating or operating multiple accounts for the purpose of abuse, circumventing limits or bans, or manipulating features is strictly prohibited.

Violation of this clause may result in immediate termination of all associated accounts without notice, without refund, and without any obligation to restore data.

You are solely responsible for maintaining the confidentiality of your password, session tokens, and other credentials, and for all activity that occurs under your account.

We are not liable for any loss, damage, unauthorized transaction, or other harm resulting from your failure to secure your credentials. You must notify us promptly if you suspect any unauthorized access.

Without our prior written permission, you must NOT use scrapers, crawlers, spiders, bots, headless browsers, CLI tools, browser extensions, scripts, macros, or any other automated means to access, monitor, copy, or interact with the Service or any of its APIs.

Detected automation may result in immediate IP-address blocks, account suspension or termination, and, at our option, legal action. We may use technical measures to detect and prevent automated access.

All data served by the Service, including prices, product metadata, price history, coupon data, aggregated statistics, images, and editorial content, is licensed to you solely for personal, non-commercial use.

You must NOT resell, republish, redistribute, sublicense, feed into another product or service, or use the data to train, fine-tune, evaluate, or benchmark any machine-learning model, dataset, or derivative product, whether commercial or not, without our prior written permission.

You must NOT reverse engineer, decompile, disassemble, translate, or attempt to derive the source code of the Service; circumvent authentication, rate limits, or access controls; or probe, scan, or test the vulnerability of any system, network, or endpoint.

A narrow good-faith safe harbor applies for security researchers who comply with the Security Research clause below; any activity outside that safe harbor is unauthorized.

Your use of the Service is subject to per-IP and per-account rate limits, which we may change at any time without notice.

Exceeding rate limits may result in temporary throttling, blocking, or permanent suspension of access at our sole discretion.

You must not use the Service's alerting, email, or notification systems to spam, harass, threaten, defame, impersonate, or otherwise abuse any person or entity.

You must not use the Service to transmit malware, phishing links, unlawful content, or content that infringes the rights of others. Violations may result in immediate termination and, where appropriate, referral to law enforcement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OPERATORS, OWNERS, OFFICERS, DIRECTORS, DEVELOPERS, CONTRACTORS, AFFILIATES, SUCCESSORS, ASSIGNS, HOSTING PROVIDERS, OR PAYMENT PROCESSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, LOST TIME, LOST SALES, BUSINESS INTERRUPTION, FAILED PURCHASES, MISSED DEALS, EMOTIONAL DISTRESS, OR REPUTATIONAL HARM.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, and even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to the Service or these Terms shall not exceed USD $0 (zero). The Service is provided free of charge; no amount has been paid and no amount shall be recoverable.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING AGAINST US.

All disputes must be brought in your individual capacity. A court or arbitrator may not consolidate claims or preside over any form of representative proceeding.

You agree to indemnify, defend, and hold harmless the Service, its operators, owners, officers, directors, developers, contractors, affiliates, successors, assigns, hosting providers, and payment processors from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any law or regulation; (d) your infringement of any third party's rights; or (e) any content you submit through the Service.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense. You may not settle any such matter without our prior written consent.

EXCEPT WHERE PROHIBITED BY NON-WAIVABLE LAW, NO WARRANTIES OF ANY KIND ARE GIVEN, WHETHER EXPRESS, IMPLIED, STATUTORY, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN SUCH JURISDICTIONS OUR DISCLAIMER APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We are not liable for any delay in or failure of performance caused by events beyond our reasonable control, including acts of God, war, terrorism, cyberattacks, pandemics, epidemics, civil disturbances, government orders, sanctions, embargoes, strikes, power outages, internet or telecommunications infrastructure failures, or failures of third-party providers.

You represent and warrant that you are not located in, a national of, or ordinarily resident in any country subject to a comprehensive trade embargo by the United States, the United Kingdom, the European Union, or any other jurisdiction applicable to the operator, and that you are not listed on any applicable denied-parties, specially-designated-nationals, or sanctions list.

You must comply with all applicable export control, sanctions, and anti-terrorism laws when using the Service.

The Service, including all user interface elements, source code, object code, graphics, text, photographs, videos, brand marks, logos (including "Pricafy"), trademarks, trade dress, domain names, design marks, know-how, patents, patent applications, and all other proprietary material, is and shall remain our property or that of our licensors, and is protected by copyright, trademark, patent, and other intellectual-property laws.

No license or right is granted to you under these Terms except a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service as an end user in accordance with these Terms.

Product listings, images, descriptions, and other product data originating from AliExpress remain the property of AliExpress, Alibaba Group, or the respective third-party owners.

If you believe that content on the Service infringes your copyright, you may submit a written notice to our designated agent at support@pricafy.com that includes: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

We will process notices in accordance with the U.S. Digital Millennium Copyright Act and any equivalent applicable law. We reserve the right to terminate the accounts of repeat infringers.

By submitting any content to the Service (including product URLs, feedback, reports, screenshots, comments, or suggestions), you grant us a perpetual, worldwide, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, translate, publish, display, distribute, and create derivative works from that content for any purpose relating to the Service or our business.

You represent and warrant that you own or have sufficient rights to grant this license and that the content does not infringe or violate the rights of any third party.

Any feedback, suggestions, ideas, feature requests, or other material you submit to us ("Feedback") becomes our sole and exclusive property, with no compensation, attribution, or accounting owed to you.

"AliExpress", "Alibaba", and all other third-party marks referenced on the Service are the property of their respective owners. Their use or display on the Service does not imply endorsement, sponsorship, affiliation, or partnership.

You must not use our trademarks, logos, or brand elements without our prior written consent.

Our Privacy Policy is incorporated into these Terms by reference and governs our collection, use, and disclosure of your personal information.

In the event of any conflict between these Terms and the Privacy Policy with respect to data-handling matters, the Privacy Policy shall control.

The Service uses cookies, local storage, and similar technologies for functional, analytical, and (where applicable and lawful) advertising purposes, as described in our Cookie and Privacy Policy.

Your continued use of the Service after being notified of our cookie practices constitutes consent to those practices to the extent permitted by applicable law.

We may retain server logs, request metadata, IP addresses, device identifiers, and user-action records for security, fraud-prevention, audit, legal-compliance, and operational purposes, up to the maximum period permitted or required by applicable law.

You must send notices to us at support@pricafy.com. Informal communications, social-media posts, and support-channel messages do not constitute legal notice.

These Terms, together with our Privacy Policy and any additional terms that apply to specific pages, products, or features of the Service, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

No modification of these Terms is binding unless made in writing and expressly referencing these Terms, or posted by us as an update to this page.

If any clause of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining clauses shall remain in full force and effect.

The invalid clause shall be reformed to the closest enforceable approximation of the parties' original intent, or, if reformation is not permissible, severed from these Terms.

We welcome good-faith security research conducted under the following conditions: (a) no exfiltration of data beyond the minimum necessary for proof of concept; (b) no degradation or denial of service; (c) no harm to third parties; (d) immediate private disclosure to us at support@pricafy.com; and (e) no public disclosure for 90 days after the initial report, or until we have remediated the issue (whichever is earlier).

Activity within this safe harbor is authorized and will not be pursued. Any activity outside these conditions is unauthorized and may result in legal action.

We may, without prior notice to you where permitted by law, comply with subpoenas, warrants, court orders, regulatory requests, or other legal process relating to your use of the Service.

We may preserve, disclose, or produce account information, logs, and other records as we deem reasonably necessary to comply with legal process or to protect our rights, users, or the public.

Section headings and clause titles are provided for convenience only and have no legal effect; they shall not be used to interpret the substantive provisions of these Terms.

References to "including" shall be read as "including without limitation". References to the singular include the plural and vice versa.

We reserve the right to modify, update, or replace these Terms at any time in our sole discretion, without prior individual notice. The "Last updated" date at the top of this page indicates when the most recent changes were made, and the Version field identifies the current version.
